Mesothelioma Victim Settlement
For decades, workers, family members and communities
were exposed to the deadly effects of asbestos. All forms of asbestos
have been shown to cause deadly and serious health effects, including
mesothelioma, lung cancer and asbestosis. A mesothelioma settlement
allows any parties involved in an asbestos-related suit to resolve
a case without going to trial. The high number of asbestos-related
lawsuits has caused about 70 corporations to file for bankruptcy
and thousands of claims to get stuck in court dockets.
In order to address the large number of unresolved
asbestos-related lawsuits, an asbestos bill was first proposed
in 2000 but has yet to be finalized. Held up in debate and controversy,
some victims diagnosed with mesothelioma cancers have been entitled
to large compensation packages and have chosen to reach a mesothelioma
settlement claim. Mesothelioma is a rare and fatal cancer associated
to asbestos exposure.
Companies have been accused of knowing the dangers
of asbestos long before a more general public knowledge in the
1970s of the risks involved began to be better understood. Because
of the widespread use of asbestos at the time, asbestos companies
have been accused of keeping quiet and allowing deadly exposure
risks to continue for a continuation of profits. Over the years,
mesothelioma settlements have been reached, most often representing
workers. According to government health researcher reports, a
new rush of asbestos victims are expected to surface over the
next two decades, indicating the number of mesothelioma settlements
has not yet reached its peak.
Since mesothelioma can be diagnosed as many as 50
years following asbestos exposure, the scope of the asbestos problem
cannot fully be determined. Many people suffering asbestos related
illnesses are worried the high number of cases in the system and
the debate over the guidelines of proposed asbestos bills will
cause delays in receiving damages that will extend beyond their
mesothelioma prognoses. From diagnosis to death, mesothelioma
is a fast-killing form of cancer with no cure, and a mesothelioma
settlement can sometimes be reached to avoid potentially long
delays in court.
Though there are now workplace and environmental
standards enacted to protect workers and communities from unhealthy
levels of asbestos, an American Thoracic Society (ATS) study released
in September 2004 said asbestos continues to be a hazard for 1.3
million workers in the construction industry and for workers involved
in maintenance of buildings and equipment. Currently, the guidelines
for the asbestos bill proposed by Sen. Orin Hatch has been criticized
for being too exclusionary, which would not allow a high number
of people suffering from asbestos related illnesses to reach mesothelioma
settlements if legislation passes.
Mesothelioma settlement terms can result from a
wide range of factors. Due to the severity of mesothelioma, a
fair mesothelioma settlement should cover the high costs often
associated to the medical treatment, in addition to the pain and
suffering and any other damages. The ATS study warned that new
products might contain asbestos, listing brake pads, roofing material,
vinyl tiles and imported cement pipe and sheeting. The asbestos
epidemic is not over, according to the nation's best asbestos
specialists that gathered in September 2004 that included participants
from major medical centers, federal agencies and universities.
